What do I need to consider when making a Will? 1. Who you wish to appoint as your Executor(s). 2. Who you wish to name as beneficiary(s) of your estate. 3. The amount you wish to give to each beneficiary. 4. Whether you wish for specific items to be given to specific beneficiaries such as jewellery, photos etc. 5. If you have children under the age of 18, who you wish to appoint as guardian of your children. Can I make my own Will or use a DIY Will kit? It is possible to make your own Will, but you should be aware that if it is not properly written, signed or witnessed it may be invalid. When Newport Law’s experienced staff prepare your Will, your needs and wishes will be clearly set out and you will have a professionally prepared document that will prevent unnecessary difficulties for your beneficiaries. What happens if I do not have a Will? f you do not have a Will or a valid Will then your property will be distributed according to the laws of intestacy. This may result in the distribution of your property in the way you would not have wanted. If you do not leave a Will, the legal procedures in administering your estate are more complicated, costly and time consuming. This may cause unnecessary expense, worry and even hardship to your family. What is a Will? A Will is a legal statement by which you name the people you want to receive your property and possessions when you die. Are there instances where a Grant of Probate or Letters of Administration can be avoided? Yes. Not every estate requires a Grant of Probate in order to administer. If the assets of the estate do not include real estate and are only minimal then the investment bodies may waive the requirements for a Grant of Probate and accept some form of executor indemnity in its place. If all the assets of the deceased were held jointly, then a Grant of Probate will not be required. All assets held jointly, by virtue of survivorship, may be transferred to the surviving joint tenant without requiring a Grant of Probate. What if there is no Will? When a person dies without leaving a Will or a valid Will, but leaving an estate that requires administration, the estate is then dealt with in accordance to the laws of intestacy. A Grant of Letters of Administration will need to be applied, unless in circumstances set out below. What is my role as executor? As an executor of an estate it is your obligation to identify the assets and liabilities held by the deceased, obtain a Grant of Probate of the Will (if necessary, see below) and, pursuant to that Grant of Probate, proceed to collect the assets, pay the liabilities and distribute the assets to the beneficiaries as provided for in the Will. What is a Grant of Probate? A Grant of Probate is essentially the approval of the Supreme Court which confirms the author of the Will has died, the Will is authentic and the executor is who they say they are. Once a Grant of Probate has been made by the Court the executor can proceed to redeem, transfer or otherwise dispose of the assets of the deceased and distribute those assets pursuant to the terms of the Will.
