Frequently Asked Questions
If you have a car accident on your direct way to or from work you will need to lodge a notice of claim with the correct third party insurer.
You will also need to lodge an application for compensation with WorkCover. However, as is the usual case, there will be no negligence alleged against your employer so a common law claim will proceed only against the compulsory third party insure.
No, it is against unfair dismissal laws for your employer to fire you for making a personal injuries claim.
If I am injured at work and make a claim, will I lose my job?No, it is against unfair dismissal laws for your employer to fire you for making a personal injuries claim.
What if I can't prove someone's negligence caused my injury? If you cannot prove negligence against another party than you cannot make a common law claim. However, there may be other statutory bodies or insurance agencies through whom you may be able receive compensation. You should seek legal advice regarding this.
How to claim personal injury compensation in Queensland, Australia. The claims process in Queensland can often seem illogical and confusing to people who are not familiar with the various systems that operate in Queensland. It is for that reason that we advise that you should click contact us so that we may advise you as to the best course of action.
Generally, the claim process is initiated by lodging of a notice of claim form, of which there are several types depending upon the type of accident, i.e., WorkCover / work related, road accident / motor vehicle, public liability or medical negligence. It is necessary for the plaintiff to lodge the correct notice of claim with the relevant insurer / defendant within the time frames stipulated by the particular act governing the action. Furthermore it is necessary that the claim form be deemed a complying claim form within the time limits.
It is often necessary that a medical certificate from your doctor accompany the notice of claim. Once the notice of claim form has been deemed ‘compliant’ the action will be governed by the relevant provisions of the applicable legislation pursuant to which the notice of claim has been served.
For assistance in drafting a notice of claim or to seek further advice regarding making a claim in Queensland Australia, click make a free compensation claim enquiry.
How long after successfully concluding a claim do I get my money? It will take up to 3 months for the settlement monies to be passed on to you after settlement, in more complex court related matters this could be longer. This is because a cost assessment needs to made, an agreement as to costs met, and repayments made to Medicare etc.
Does Accident Compensation Advice only deal with accidents and injuries that happen in Queensland, Australia?Does Accident Compensation Advice only deal with accidents and injuries that happen in Queensland, Australia?
Accident Compensation Advice deal mainly with accidents and injuries that were sustained in Queensland. This is because Accident Compensation Advice solicitors are only admitted to the Supreme Court of Queensland and the High Court of Australia. However, we also deal with Motor Vehicle accidents in New South Wales. We are able to act for any person from any corner of the world who may have been injured in Queensland whilst, for example, on holiday.
Is this service confidential?Yes, your details will only be kept on our file and kept for our use and the use of our barristers. Your information will not be passed on to any other person without your express permission.
How long will the claim take to be dealt with? This is a difficult question. A rough average would be two years however this can greatly vary. It is IRRESPONSIBLE and UNFAIR to settle a claim before your injuries have stabilised as you may be missing out on due compensation. To that end, it is almost impossible to settle a claim within 12 months. The time it takes to settle a claim is influenced by a number of factors but mainly the types of injuries you have an the time that you take to recover from them. The length of some claims are also determined by the legal process or sometimes the attitude of the defendant insurer and/or solicitor towards a particular claim. Your solicitor will able to give you an approximate indication as to the time your claim will take and a more definite indication once medical reports are received and in light of any other complications that may arise.
Do I have to pay costs and outlays throughout the claims process? No. All professional costs and outlays are only paid upon the successful conclusion of the claim and deducted from the settlement sum. It is illegal to take a percentage of the claim as costs must be assessed by an independent assessor as to the actual work done.
What if a person dies before bringing a personal injury lawsuit? The deceased person’s estate via the executor of the estate may be able to make a personal injuries claim and should seek legal advice immediately. Click here to do so. Moreover, dependents and people having witnessed the accident may also be able to make a claim and should also seek legal advice immediately.
If I drive for my job, and have a road accident during my work is it a workcover claim or a road accident claim? The simple answer is both. If you have a car accident at work you will need to lodge a notice of claim with the correct third party insurer.
You will also need to lodge an application for compensation with WorkCover. However, as is the usual case, there will be no negligence alleged against your employer so a common law claim will proceed only against the compulsory third party insurer.
By using an accredited specialist you can be confident in your advice. The firm also allows second opinions from barristers and other accredited specialists.
How much will my claim be worth? No Solicitor, irrespective of their experience or knowledge is able to tell you how much your claim will be worth from the outset. This is because the amount your claim will be worth is based upon the medical reports that will be complied as evidence in your claim and your individual circumstances including the impact of the injury has on your life.
At times liability considerations (eg contributory negligence) can have a significant impact on the quantum of your claim. Once all relevant reports have been obtained and information considered your solicitor will be able to recommend offers to you to submit to the defendant, however before such time any indication as the quantum of your claim is a mere stab in the dark.
Various states in addition to WorkCover may have a statutory scheme of compensation. Such systems are ineffective and cannot provide the compensation that the common law can, however, to receive money from these statutory schemes you do not have to prove negligence against the wrongdoer.
