I was completely ecstatic with my legal team provided to me by Gerard Malouf and Partners. My legal team comprised of my instructing solicitor Mrs Lana Ventsov, and my delightful barristers Mr Barry Hall QC and barrister David Elliot. I was nervous at all times, but they made me feel very important and most of all, they gave me the courage to continue along in my pursuit to win my case, especially when no one believed in me. I was in Grade 2 and we were having “show and tell”. When asked to comment on what I call my “stick drawings”, I had replied that my artwork represented that “when I grow up I want to be a lawyer and have a red Ford Capri convertible” (the car which was all the rage at the time). I guess I have not changed much since then. I am still as determined as ever. My main focus is achieving justice for my clients. Following University, I commenced work with a Compensation and Neglience law firm, with Insurance Companies as my clients. I remained in that role for a year and a half. My role was litigation based and I would run various Notices of Motion against quite experienced barristers and be successful. Working for the other side of the fence, I now brief one of those barristers, whom I was successful against. To avoid restricting myself, and to allow for further personal development, I then accepted a position of employment with a Banking and Finance law firm. I remained in that role for approximately 6 months. From that time , I have been with the the Compensation Law Firm Gerard Malouf. I find having worked in the same area of law on the other side of the fence quite advantageous. I am aware of the complete “tricks of the trade”. As a lawyer, it also means that the experience and knowledge gained has enabled me to “think outside the square”. Other facts about me are that I have had 9 years worth of experience at my local pharmacy. I enjoy watching soccer games. I have also had various articles published in my local paper and the Daily Telegraph. Now that I am “grown up” I would eventually like to become a barrister. That has always been my intention. As for that car, that wish has also grown. I now wish for a Lotus Elise. As for those “stick drawings”, some things never change!

Another notable matter that comes to mind is where 3 siblings were left out of the Will of their abusive father, whom left all funds to the RSPCA and Salvation Army. After the commencement of proceedings and lengthy settlement discussions, keeping in mind that our clients did not want to take too much money away from the charities, David was able to secure the clients $100,000.00 each from an estate that had a net worth of $800,000.00. In his time at Gerard Malouf and Partners David has become our key Solicitor in dealing with Family Provisions and Contesting of Wills cases. “I like to ensure that those who are in need receive what they deserve, I do not like dealing with claims that are merely pursued to obtain funds from the estate. If a person is in need or disadvantaged because they have been left out of a Will, I will do everything in my power to fight for them.” This view is a key belief of Gerard Malouf and Partners, and is in line with our undertaking to fight for the disadvantaged and not to pursue frivolous claims. What if I am an Executor of a Will being challenged?

At Gerard Malouf & Partners we understand that the financial burden of making a claim, challenging a Will, can deter you from obtaining expert legal advice, because of the cost of legal fees. Is there a time limit on making an application?

There are strict time limits on contesting a Will. An application must be made within twelve months of the date of death of the deceased. If an application is made outside of this time than it is necessary to prove to the Court that there is sufficient cause for the application to be accepted outside of time.

Who is an eligible person? You are classified as an eligible person if you are:
  • The husband or wife of the deceased person at the time of their death;
  • Were in a de facto relationship with the deceased person at the time of their death;
  • Are a child of the deceased person including adopted children;
  • Are a former husband or wife of the deceased person;
  • Is a grandchild of the deceased and were a member of there household at any time and wholly or partly dependent upon the deceased at any time.
  • Were living in a close personal relationship with the deceased person at the time of their death. A close personal relationship means a relationship between two adults living together (whether related or not) where there is the provision of domestic support and personal care.
