Frequently Asked Questions

Do I have to go to court? When should I see a solicitor? If you have recently separated or are contemplating separation, it can be very useful to obtain the proper legal advice regarding your rights and responsibilities. A family law solicitor will be able to discuss your specific circumstances regarding any property of the relationship and/or children's arrangements and can guide you in the right direction for the most efficient and cost effective solution. Do I need to bring anything to my first appointment? It is not necessary to bring anything along to your first appointment however if you and your former spouse have come to any kind of agreement regarding property division or parenting arrangements previously, it may be helpful to provide the solicitor with a copy of any such agreement. If you matter involves property settlement, it can also be beneficial to bring any relevant financial records and documents however these can always be obtained from you further down the track. Do I still need to consult a solicitor if we have reached agreement? Yes, it can certainly be beneficial to discuss the proposed agreement with a specialist family law solicitor to ensure that it is fair and reasonable in the circumstances. It may also be wise to formalise your agreement by way of consent orders to protect yourself. A solicitor can assist you with this process. My husband says that because I haven't worked, I won't get anything if I leave him. Is that true? No this is not necessarily true.
