Motor Vehicle Accident Claims
If you have been injured in a motor vehicle accident in South Australia you may be entitled to compensation.
All claims involving a vehicle registered in south Australia are handled by Allianz Australia. If the vehicle that caused your injury cannot be identified or was not insured, claims will be handled by the nominal defendant. In cases where the vehicle which caused your injuries is registered in another state, we can help prosecute your claim on your behalf against the Insurance company concerned.
In most cases, if your driving has not caused or not beenĀ the principal cause of a collision and you suffered injuries, you will be entitled to compensation. Even in cases where your actions have materially caused or contributed to the cause of the collision, you may be entitled to compensation.
Generally, if you have been involved in a collision, a plaintiff (injured person) has three years from the date of the collision in which to file legal proceedings, however, we strongly recommend that you seek our legal advice promptly after a collision so as to avoid complications and risk becoming statute barred.
In the case of infants (children under 18 years), a plaintiff generally has up to his orĀ her 21st birthday to file legal proceedings. In this instance we again strongly recommend that you seek our legal advice well in advance of your child's 21st birthday, but in any event as soon as possible after the collision.
The sooner you instruct us after your motor vehicle accident, the sooner we can give you comprehensive legal advice regarding liability, causation and how much compensation you might be entitled to.
We will visit you in hospital, your home or you can visit us. It is important that we commence acting as soon as possible so that you are informed of your rights and responsibilities and we can help you gather the evidence needed to maximize your compensation.
