Arbitration and Mediation (ADR) Lawyers

Disputes are sometimes inevitable between individuals or between parties. Instead of bringing the problem to court, both parties can reach an agreement with the help of a third party or mediator or an arbiter. Arbitration and mediation happens in a confidential setting; thus there is no danger that any confidential information about the dispute or settlement will leak to unauthorized ears.

What is Arbitration and Mediation (ADR)?

Arbitration and mediation (also known as alternative dispute resolution or ADR) is a form of dispute resolution wherein no court hearing is involved. Parties in dispute who agree to go into the arbitration and mediation process undergo a legal proceeding under the guidance of an arbiter or mediator. The arbiter or mediator uses a legal technique in resolving the dispute of the disputant parties. The process that arbiters use in solving disputes may be similar to that used in court hearings. Arbiters are given the power to make legal decisions concerning the dispute. Meanwhile, both parties in dispute must agree to whatever decisions that arbitration and mediation lawyers come up with in the course of the arbitration and mediation process.

Who Needs Arbitration and Mediation Lawyers?

There are certain circumstances that a dispute can be solved without a court hearing. It may be that both parties do not want the case to go into court because they do not want the public to know about the dispute. In cases such as this, parties in dispute can hire arbitration and mediation lawyers to help them come up with an agreement and a settlement over the problem.

Some of the many cases that arbitration and mediation lawyers may be of much help are:

  • Labor disputes such as unjust termination, compensation problems, discrimination in the workplace, harassment, grievances, and labor management
  • Family disputes such as concerning family businesses, adult sibling conflicts, eldercare issues, child custody and visitation, financial support to children and spouse, divorce and separation, and budget disagreements
  • Consumer disputes
  • Disputes between states and investors
  • Commercial disputes
  • Partnership disputes
  • Disputes over contracts of any kind
  • Medical malpractice
  • Disputes between landlords and tenants
  • Disputes between homeowners and contractors or builders or realtors
  • Environmental and land use disputes
  • Disputes between insurance companies and insurance holders

Arbitration and mediation lawyers are specifically trained on the legal aspects of these areas. They are trained well to help disputant parties come up with an agreement and make a settlement on the existing problem without further bringing the problem into court. All transactions done with arbitration and mediation lawyers are usually kept confidential so people who hire their services can be sure that confidential information regarding the dispute and the settlement will not reach the knowledge of the public.

If you are looking for help over a certain dispute you want to be kept confidential, ask the advice of an arbitration and mediation lawyer.
