Administrative and Constitutional Lawyers
Individuals, groups, bodies or agencies delegated as decision makers or having powers under statutes are themselves bound by rules and regulations or laws. They should follow these laws while exercising authority over their subjects. They are bound to follow the administrative and constitutional law set by the constitution of Australia.
What is Administrative and Constitutional Law?
Administrative law is a subset of constitutional law. While constitutional law is mainly focused on the legislative aspect or the legislative actions of decision makers and the legality of their power statutes, administrative law is focused on how government officials and agencies exercise their powers as mandated or designated by the legislature. Administrative law is intended to exercise control over government officials and curb potential abuses of power by them. It is also intended to ensure that government officials or agencies or bodies exercising authority perform their duties as mandated to them by the government or Australian constitution and that they do not go beyond the scope of power that was delegated to them.
Who Needs Administrative and Constitutional Lawyers?
Administrative and constitutional lawyers can help protect the rights of workers of both the private and public sectors. These lawyers can help them fight for their rights in compensation and labor and employment. Administrative and constitutional lawyers are also needed by people who feel they are deprived of their human rights and if they feel they have been abused by the people exercising authority over them.
Anyone under the statutory authority of a certain official such as government official, government school official, or any other people in power can ask for the services of administrative and constitutional lawyers when they feel they have been abused or have not been given due consideration of their rights.
The scope and expertise of administrative and constitutional lawyers can include the following:
- Trades and professions (including discipline and licensing bodies). This can include taxi drivers, street vendors, direct sellers, people working in the real estate business, and professionals in law, medicine, nursing, and many others.
- Employment and income support. This can include matters on employment standards, labour relations, unemployment insurance, health and safety compensation for workers, and employment equity.
- Economic regulation. This can include taxation, securities marketing, and competition law.
- Consumer protection and health services. This can include food and drug, public medical plans, financial institutions, retail products, and human rights to basic commodities.
- Social control. This can include paroles for prisoners, imprisonment, immigration and deportation, and psychiatric institutions.
- Land use regulators which scope include forest and mining practices, fire safety, impact of pollution on environment, and sewers and drains.
- Industry regulators. This can include transportation, communications, agricultural marketing boards, electricity and gas, and licensing for food and drugs.
Administrative and constitutional lawyers are specifically trained on these areas. If you have queries and you need advice on these aspects, contact a qualified administrative and constitutional lawyer.
